The Society of Garden Designers (SGD) has unveiled two new contracts that aim to define the roles of customer, designer and landscaper and help raise standards within the domestic landscape market...
The JCLI Consultancy Agreement and Landscape Contract for Homeowners have been produced by the Society and approved by all members of the JCLI Contracts Forum.
Welcoming the introduction of the contracts, Paul Cowell, National Chairman of BALI, said they would “provide reassurance for all parties and remove the potential for misinterpretation”.
He added: “Formal contracts protect against exploitation and prescribe a framework within which disputes can be resolved promptly.”
The Consultancy Agreement is intended for when a domestic customer appoints a designer to design and, potentially, oversee the construction and planting of a garden by a landscape contractor. It sets out the obligations of the designer and client and gives guidance on scheme design stages, tendering and implementation of the Landscape Contract.
The Landscape Contract for Homeowners is a domestic garden construction and planting contract for use between the client and contractor, with the client representing the customer and overseeing the contractor work.
The SGD recommends that the contracts should be applied in tandem and has made them available to buy as a set for £17.50, plus VAT and P&P. To order the contracts and download the Practice Note and Model Forms, visit www.sgd.org.uk/JCLI_Garden_Construction_Contract_and_Consultancy_Agreement.aspx
Training in the use of the contracts will be available in 2012.
