JCLI Contracts Amendments:  CDM Regulations 2015

The JCLI Scottish Agreements have been revised to accommodate the CDM Regulations 2015.  Note that the relevant JCLI Amendment 1 should not be included with the JCLI Contract.  The standalone Scottish Novation Agreements have been modified to clarify that they apply to the 2013 and 2015-04 versions of the JCLI Scottish Landscape Maintenance Works Agreement:

Landscape Works Contract

LWC 2012 Landscape Works Contract 2012 (JCLI LWC 2012)
A Standard Form of Agreement and Conditions of Contract for Landscape Works, predominantly for use as a ‘commercial’ contract, which replaces all previous editions and revisions of the JCLI Landscape Works Contract. From 6 April 2015 Amendment 1 for JCLI LWC 2012 should be used with this contract (see below).

The Contract has been updated to take account of the amendments to the Construction Act as well as other amendments from the JCT Minor Works Building Contract 2011. The revisions to the payment provisions in the 2012 edition are extensive and guidance on the changes is provided in the JCLI Practice Note No 8 Revision 1 (June 2012) and the Model Certificates and Other Forms document for the contract (June 2012) which are free downloads below.

Scottish Landscape Works Agreement April 2015 (JCLI SLWA April 2015)
This Agreement enables JCLI LWC 2012 to be used in a manner consistent with Scottish Law. It does not replace the JCLI LWC 2012 but the JCLI LWC is treated as a Contract Document which should be initialled and annexed to this Agreement, but Amendment 1 for JCLI LWC 2012 should not be included. The April 2015 revision of the Scottish Agreement incorporates revisions due to the CDM Regulations 2015. Landscape Works Contract with Contractor's Design

LWCD 2012 Landscape Works Contract with Contractor's Design 2012
(JCLI LWCD 2012)

The JCLI Landscape Works Contract with Contractor’s Design 2012 is very similar to the JCLI LWC 2012 but incorporates provisions for discrete elements of the work to be designed by the Contractor. It is not appropriate as a Design and Build Contract. From 6 April 2015 Amendment 1 for JCLI LWCD 2012 should be used with this contract (see below).

Landscape Maintenance Works Contract

LMWC 2012 Landscape Maintenance Works Contract 2012 (JCLI LMWC 2012)
A Standard Form of Agreement and Conditions of Contract for Landscape Maintenance Works (JCLI LMWC) which is appropriate for all types of landscape maintenance project of any value, but is predominantly for use as a ‘commercial’ contract. It includes considerable flexibility and is appropriate as a back-to-back contract with a landscape construction contract. The 2012 edition replaces all previous editions and revisions of this contract. From 6 April 2015 Amendment 1 for JCLI LMWC 2012 should be used with this contract (see below).

The revisions to the payment provisions in the 2012 edition are extensive and guidance on the changes is provided in the JCLI Practice Note No 9 Revision 1 (June 2012) and the Model Certificates and Other Forms document for the contract (June 2012) which are free downloads below.

Homeowner Landscape Contracts

 

The JCLI Homeowner documents have been produced by the Society of Garden Designers, agreed by the JCLI Contracts Forum and badged JCLI. They are based on the JCT Homeowner documents and are only for use where the client (customer) is a ‘domestic’ client acting in a personal capacity (not as a business or any other organisation, eg charity, authority).

 

The JCLI Homeowner Design Consultancy Agreement (JCLI HCA), the JCLI Homeowner Landscape Contract with Consultant (JCLI HLC/C) and the JCLI Homeowner Landscape Contract without Consultant (JCLI HLC) should be ordered from the Society of Garden Designers. Associated documents are available as free downloads from the SGD website, including JCLI Practice Note No 10, Scottish Amendments and Model Forms for use with the JCLI Homeowner Landscape Contract with Consultant.

 

Before purchasing the Homeowner Agreement and Contracts it is advisable to look at JCLI Practice Note No 10 to see whether they are suitable documents for your project.

JCLI Contracts Forum

The JCLI Contracts Forum is organised by the Landscape Institute. Its members are the Association of Professional Landscapers (APL), the British Association of Landscape Industries (BALI), the Horticultural Trades Association (HTA), the Institute of Chartered Foresters (ICF), the Landscape Institute (LI) and the Society of Garden Designers (SGD).

The Forum is concerned with contracts and associated documents for the landscape industry. Individual organisations produce the contracts and documents but they are agreed by the Forum and badged JCLI.

The JCLI badging of contracts is considered important for two main reasons: firstly, because ‘JCLI’ has a strong reputation for contracts, based on the reputation of the Landscape Contract originally produced in 1978; and secondly, because the documents are agreed by the members of the Forum and are therefore non-partisan industry standard documents.

 

History of JCLI

JCLI was originally the Joint Council for Landscape Industries and was convened in 1973 to bring together all those organisations in any way concerned with landscape design, construction or management. In 2004 it became the Joint Committee for Landscape Industries with a slightly different mission but was dissolved in 2010. The JCLI Contracts Forum was formed in 2010 by the Landscape Institute to continue the existing JCLI contracts and expand the range of contracts. ‘JCLI’ is no longer an acronym.

JCLI documents were always produced by individual member organisations but agreed by JCLI and badged JCLI. This continues with the JCLI Contracts Forum, which is only concerned with contracts and associated documents for the landscape industry.
